Spying on wife termed as stalking

 

Delhi: The court here on Monday convicted a man for one year simple imprisonment on charge of hiring detectives for spying on wife. In his statement to court he had alleged that his wife was having an extra marital affair with Mr.Amjit Gupla, a neighbor.
The husband Mr. Abhijak Sherma, had managed to capture their intimate act, when Mr.Gupla and Mrs. Sherma were satisfying their carnal desires in a hotel room.  He had hired a detective agency for the expose and then filed divorce on grounds of adultery under Hindu marriage Act, citing the evidence gathered.
The case took a bizarre turn when the husband was accused of stalking and was arrested under IPC 354.  It should be noted that after 16 Dec Delhi rape incident, the government – bowing to media hype had crawled when asked to bend and – passed new anti-rape laws. Hence the court took suo moto cognizance itself on the husband’s statement.
The IPC section 354C says, “Whoever watches, or captures the image of, a woman engaging in a private act in circumstances where she would usually have the expectation of not being observed either by the perpetrator or by any other person at the behest of the perpetrator shall be punished on first conviction with imprisonment of either description for a term which shall not be less than one year, but which may extend to three years”.
While giving order court also observed that when there is no law to punish wife for being adulterous. Then, how can anyone even think that women can make a such relation with any other man apart from her husband.
